The Fallacy of Fair

We often hear clients talk about wanting to use mediation to obtain a “fair” result. While this makes perfect sense, and can be aimed for, mediation is actually less about fairness and more about coming to a mutually agreed upon decision. This can occur even when the agreement is not perfectly '“fair”. Another question to consider is what is “fair”?. What is fair can vary greatly from person to person, Your mediator is actually not there to determine fairness, which is a value judgment. Your mediator is there to help guide your journey through mediation, uncovering areas of commonality where agreement might be possible.
